Ludlow Farmhouse Vacation Rental Agreement
By renting via Air BnB, all renters in the home agree to all terms and conditions of this agreement
This vacation rental contract is a legal agreement between Charles and Heidi Rose (also referred to as the “Homeowners” and “Owner” and “Landlord” and “Property Manager”) and you, the Renters (also referred to as “Tenants” and “Guests”). This contract is entered into agreement as of the date when the Renters place their reservation online and the reservation is screened and accepted by the Homeowner. The Homeowner will notify the Renters by email when their reservation is accepted. Owner reserves the right to refuse service to anyone.
1.CHECK-IN TIME IS AFTER 3pm EST and CHECK-OUT is 10am EST. NO Early Check-ins. This agreement does not create a tenancy or residence. You must depart at the appropriate time.
2.NON-SMOKING - This is a NON SMOKING vacation rental. Evidence of smoking, such as the smell of cigarette or cigar smoke inside the home by the cleaning crew is sufficient basis to charge the renter for smoke cleanup and removal from carpeting, air ducts & filters and furniture. This type of clean up is expensive and Renter is Liable for the deep cleaning Costs incurred.
(website hidden) PETS ALLOWED. If you bring a pet(s), this rental agreement will be forfeited, terminated and deposits will be retained and a deep cleaning fee will apply.
4.The Renter must be 25 years of age to book this Vacation Rental.
(website hidden) PARTIES - This is not a party house. Any special occasions such as weddings, receptions, family reunions or increase of occupants (guests not registered on registration form) must be disclosed at the time the reservation is made and is subject to Owner's advanced approval. Prom parties, fraternity or sorority parties, and/or graduation parties are not allowed at any time. Adults cannot rent property on behalf of underage guests, no exception.
(URL HIDDEN) DEPOSIT- CSA Travel Insurance OR a damage/reservation deposit of the greater amount of 20% of total rental cost or $1000 minimum is required. This must be received within seven (30) days of booking the reservation. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met.

(website hidden) charges are incurred due to contraband, pets, or collection of rents or services rendered during the stay.
c.All debris, rubbish, and discards are placed in garbage bags that are placed into the trash cans provided outside. Also all soiled dishes are placed in the dishwasher and cleaned.
d.All windows are closed and locked.
e.All keys are left in the lock box and the unit is locked.
f.All charges accrued during the stay are paid prior to departure.

i.Driveway used properly and no damage to other property.
j.The renter is not evicted by the owner (or a representative of the owner), local law enforcement, security company, or property manager.
7.WATER AND SEPTIC- The house is on well and septic systems. The septic system is very effective and inspected regularly, however it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. NO FEMININE PRODUCTS, WIPES, OR DISPOSABLE TOWELS SHOULD BE FLUSHED AT ANY TIME. If it is found these products, or anything other than toilet paper, have been flushed and clog the septic system you could be charged damages of up to $1500. Each wastebasket will have garbage bags to make disposing of these items easier, feel free to wrap them in extra toilet paper and throw in the trash. The well water was tested to be very clean in 2013 and tastes great!
8.PAYMENT- An advance payment equal to 50% of the rental rate is required 60 days before arrival. The advance payment will be applied toward the rent. Please make payments in the form of personal check, bank money order, or cashier’s check payable to Chuck and Heidi Rose. If renter’s name and address is not printed on the check you must include a copy of the renters valid state issued driver’s license. The advance payment is not a damage deposit. The BALANCE OF RENT is due (30) thirty days before your arrival date.
9.CHECK OUT POLICY- Prior to check-out please do the following:
1.Please take all trash (including bathrooms) and recyclables and place them in the respective cans outside the basement doors
2.Please load all dishes into the dishwasher and run it on the normal cycle
3.Please turn the heat down to 58° F in the winter
4.Please leave the fireplace on OFF (Pilot Setting per instructions)
5.Please close and lock all windows
6.Please lock all doors

10.CANCELLATIONS- A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty except if deposits were made via credit card. All credit card cancellations are subject to a 5% cancellation fee or $50 whichever is greater.
Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment and damage/reservation deposit. Cancellation or early departure does not warrant any refund of rent or deposit.
11.MAXIMUM OCCUPANCY- the maximum number of guests is limited to ten (10) persons. An additional charge of $25 per person per night for guests in addition to ten (10) will be assessed and the owner or property manager must be notified before check in or as soon as possible.
12.THIS PROPERTY REQUIRES A TWO (2) NIGHT MINIMUM STAY. Longer minimum stays may be required during holiday periods.
13.INCLUSIVE FEES- Rates include a one-time linen and towel set-up. Amenity fees are included in the rental rate.
(website hidden) DAILY HOUSEKEEPER SERVICE- While linens and bath towels are included in the unit, daily housekeeper service is not included in the rental rate; however it is available at an additional rate. We suggest you bring beach towels (handy in all seasons) We do not permit towels or linens to be taken outside the home.
15.RATE CHANGES- Rates subject to change without notice.
16.CHILD PROOFING: Guest understands that no special efforts have been made to “childproof” this house, and accept the risk or harm to any children we allow on the property. These risks are not limited to, but include access to the adjacent properties, rivers, lakes, adjacent street, cleaning supplies in the house and plants in the house, patio and on the street, that might be poisonous if ingested.
17.CONDITION OF PROPERTY: Owners have, to the best of their ability, given an accurate description of the property and its condition. Guest understands that it is considered as reserved "sight unseen". Our cleaning staff will have cleaned it before your occupancy. All electrical, plumbing and appliances should be in working order. The failures of operation of certain extra amenities, such as large screen TVs, cable, games, or the Internet and WiFi service are not a basis for any refund. Owner will make every effort to have these items repaired but does not guarantee that they will be repaired during Guests occupancy. When you arrive, if you find that the house has not been cleaned to normal standards please notify the Owner immediately. We will do our best to have tradesmen attend to the problems but may not be able to fix everything over holidays and weekends. Under no circumstances will any of the rental money be refunded or returned because of the condition of the house. The Guest agrees to hold the Owner harmless from any liability for the condition of the house. Due to the nature of being in Vermont, there is always a potential for rain, snow and ice which can make any surface slippery. Take caution at all times and use at your own risk.
18.FALSIFIED RESERVATIONS- Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check in.
19.SUBLETTING: Guest is not authorized to let or sublet all or any part of the premises nor assign the lease or any interest in it without the prior written consent of the Owner.
20.WRITTEN EXCEPTIONS- Any exceptions to the above mentioned policies must be approved in writing in advance.
21.PARKING- Park only on the stone driveway (will be plowed clearly in the winter). Any damages from parking on other parts of the property will be subject to maximum penalty due to service truck access and also potential damage to septic systems.
22.KEYS - Lost keys will incur replacement costs of $50.
23.WEATHER OR STORM POLICY- No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained; however, we highly recommend four wheel drive and/or chains and/or snow tires during the snow months. We do not refund due to road conditions.
