SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is made by and between Frank Leone (“Homeowner”) and(“Guest”) as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
1.Property. The property is located at:
Villa Leone at Villas Paraiso
Km. 3 Caraterra Cabarete Sabaneta
Cabarete, Puerto Plata
The property is furnished and includes linens, towels, daily maid service, cable tv.
2.Rental Party: The rental party shall consist of Guest and the following persons:

3. Maximum Occupancy: The maximum number of guests is limited to14 persons. This is based on 12 in beds and 2 on an inflatable queen air mattress or sofa. An additional charge or $30 per person per night for guests in addition to the reserved number will be assessed. Any changes in occupancy must be made prior to arrival at villa.
4. Term of the Lease. The lease begins at 3 p.m. on the Check-in Date and ends at 11a.m. on the Checkout Date.
5. Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
6. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

8. Cancellation Policy: If Guest wishes to cancel his/her reservation, the deposit will be refunded as follows:
For cancellations 6 months or more prior to the reserved date, a service charge of $150 will be deducted from the deposit and the balance returned.
For cancellations 90 days to 6 months prior to the reserved date, 25% of the deposit will be deducted from the deposit and the balance returned.
For cancellations less than 90 days prior to the reserved date, there will be no deposit refund.
9. Insurance: We encourage all renters to purchase traveler insurance. This insurance is available through our listing on (SENSITIVE CONTENTS HIDDEN)
10. Payment: Acceptable payment methods are [cashier’s check , money order, (SENSITIVE CONTENTS HIDDEN) or Homaway Payments.].

2.People other than those in the Guest party set forth above may not visit or stay overnight in the property. Severe financial penalties as described below will be assessed if any unregistered guests are found in or around the villa:
There will be an additional charge of $50 for each registered guest X number of reserved nights added to the reservation if this policy is not respected. For example, if there are 5 registered guests for a week and the guard reports one unregistered guest staying at Villa Leone for one night or visiting for the day, there will be a charge of $1,750 (5 guests X 7 nights X $50) added to the total for the reservation. This would be payed in cash within 24 hours of the unregistered guest being reported by security. So far, we have not had to enforce this. Hopefully, we will never have to.
3.This villa is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
4.Keep the property and all furnishings in good order

Only one rental vehicle per guest may be parked in front of the villa.
8.Housekeeping: There is daily housekeeping service, except for Sundays.
The villa maid’s responsibilities are limited to making the beds once/day, washing linens and towels and cleaning the villa. The maid is instructed to clean downstairs and outside in the early morning to afford guests the ability to sleep in if they like. The maid will then proceed to clean and make up the bedrooms. Please take care to leave the sand (as much as possible) outside of the house. Using the outdoor showers and leaving your shoes at the door help achieve this. It is not the maid’s responsibility to do repeat cleanings after her daily cleaning is complete. Cleaning of glasses, silverware, dishes, pots and pans are the responsibility of the guest and will not be done by the maid. All guests will be given one beach towel and on bath towel/week.
9.No large parties or special events such as weddings, 15 yr old birthday parties, etc. shall be held at or around the villa without previous written permission from Frank Leone. A minimum event fee of $600 will be charged for any pre approved event for up to 30 guests.
10.Possession or Use of Illegal Drugs
We have a zero tolerance policy for any illegal drugs in or around the villa including the beach in front of the villa. If any guests are seen possessing or using any illegal narcotics, they will be asked to leave and will not receive any refund for the balance of their stay. We reserve the right to detain any violators until the police arrive.
This is not just a policy statement. We mean it!
The fireplace is an electric fireplace. Please make sure that if you use it, the heating element is not turned on. It is intended for use in the illumination mode only.
12.Water and Septic: The villa is on a public water system. The mineral content in
the water is high and it is not safe for drinking. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products or any items other than toilet paper have been flushed and clog the septic system, you could be charged damages of up to $500.
13.Storms(URL HIDDEN) No refunds will be given for storms.
14.What is Not Included?
1.Laundry: Due to personnel, equipment, septic capacity and expense constraints, we do not offer laundry services in the price of the villa. Please do not ask to use the washer or dryer to wash your clothes on your own. Our staff will direct you, or, if you wish, help arrange for pick up by a nearby laundry facility for prompt service and reasonable fees. I have stayed at 5 star resorts and have sailed on premier cruise lines. They all charge very dearly for laundry services. The cost of energy in the DR for washing and drying the clothes is 3 times that as in the USA. I hope that the above discussion sufficiently explains our reasons for not allowing personal laundry to be done at the villa.
2.Dish Washing: We ask our guests to take good care of our glass and dinner ware by washing and drying them daily. Dish cleaning is only provided if the chef services are arranged.
3.Linen and towel changes: In an effort to keep our rental costs affordable for our guests and reduce the environmental impact of the villa on the beach area, the linens will be changed once/week for multiple week stays and for stays greater than 7 nights. Towels will be changed twice/week. For example, if you are staying 9 nights, you can request the linens to be changed on the 4thor 5th day.
4.Transportation: All guests are offered airport transportation at additional cost; prevailing taxi rates. Our approved Taxi Drivers are independent contractors and are available to take you anywhere you may want to explore on your vacation. They are eager to show you a great time, assist you shopping, taking you to dinner, clubs, tours, or whatever transportation or coordination needs that you may have. It is suggested that you ask rates prior to using any drivers and pay them daily in full for any services that you have received that day.
5.Cooking: We offer a professional chef for up to 8 guests for $100/day plus the cost of groceries ($150/day for 9- 12 guests) They will prepare up to 3 meals, do the shopping and cleanup. The maid is not permitted to cook for the guests. Please pay the chef daily for the groceries. The chef services must be paid at least 60 days in advance to Frank Leone.
6.Special Events: No weddings, 15 year birthday celebrations, or any other large parties involving guests not staying at the Villa are permitted without prior written permission from Frank Leone. There is a minimum event fee of $600 for any party or wedding for up to 30 guests.
7.Early arrival and late check outs: Due to required turnaround times, we ask that all guests respect and make proper arrangements to meet our 3pm check in and 11am check out times. If, on the day of departure, there are no guests due to arrive the day of your departure, a late check out can be requested the previous day through Frank Leone only. If approved the day before departure, a charge of $20/hr. will be made for each hour after 11:00am. This also applies to early arrivals. A charge of $20/hr. will be charged for all approved arrivals before 3pm. Again, this is only permitted upon requests approved by Frank Leone the day before departures and will only be approved based on the disposition of pending arrivals. We cannot approve late check out or early arrivals at the time you make your reservation with us or when you make your airline reservation. If you need either at that point in time, please consider booking an extra day to insure the availability of the extra hours that your flights may require.
8. Hot Tub. Due to operational and environmental reasons, we are no longer operating the hot tub. We include this note here because even though we no longer mention the hot tub in our advertisements, there is mention of it in past reviews and the hot tub is still physically present but is kept empty and non operational. We do everything possible to not misrepresent what our guests should expect to insure the best experience possible.
I am a retired Professional Engineer spending time between my home in the USA and my properties in Sint Maarten and the Dominican Republic. All of my properties serve as home for me and my family several times/year and are well maintained. You won't have to worry about me looking over your shoulder while you are enjoying your vacation, although there will be someone around or in close touch by phone or email to address any concerns. I hope to get to meet some of you during your stay.
I have prepared a very comprehensive Welcome Letter that will be emailed to you after you complete your reservation. The Welcome Letter has many recommendations as to dining and entertainment in the area.
