Short Term Vacation Rental Terms and Conditions
GENERAL TERMS/CONDITIONS: Guest(s) agree to honor occupancy limits for the property and conduct yourselves in a manner respectful of our neighbors by completely refraining from loud outdoor noises, disruptive parties and behavior, over occupancy or any activity that interferes with the peace and quiet of our neighbors, traffic flow, the community or local residents. This home is located in a quiet residential neighborhood and the City of Rancho Mirage strictly enforces ordinances that prohibit unreasonable noise at any time. Violation of these terms may result in city police fines, and may at the discretion of owner result in automatic cancellation of the Rental Agreement.
RENTAL ORDINANCE: In the City of Rancho Mirage, Occupant must be at least 30 years of age or older, to rent the Premises. Children three (3) years or younger shall not comprise more than one-half of the permitted total of occupants. Other occupants are either over the age of 25, or are accompanied by an adult guardian. The foregoing requirements are set forth in the City of Rancho Mirage vacation rental ordinance. The 10% City of Rancho Mirage occupancy tax for rentals periods less than 28 days is not included in the rates.
MAXIMUM OCCUPANCY: The maximum number of guests is 4 persons, including children. Additional guests not included in the rental agreement are subject to Owner’s consent and maximum occupancy limit People other than those in the rental agreement may not stay overnight in the property. Any other person in the property is the sole responsibility of the Guest(s).
MINIMUM STAY: This property requires a 4-night minimum stay.
CHECK-IN/CHECK-OUT: Check-in time is after 3:00 PM local time and check–out is prior to 11:00 AM local time. Please arrange with the owner if there are any special circumstances.
PROPERTY UNAVAILABLE DISCLOSURE: If, after this reservation is completed, and correspondence or discussions with Guest disclose a change in circumstances involving the reservation of this property, Owner has a right to refuse a reservation to Guest if the reservation is not conducive to the welfare of the Property. Such circumstances include, but are not limited to, an event or party planned during Guest’s occupancy of the Property, violations of the occupancy limits, rules regarding pets, or the purpose of the Rental Agreement. This is not intended to be an all-inclusive list of circumstances which may cause a cancellation of reservation. If the reservation is cancelled pursuant to this section, Owner will return all monies deposited to Guest, as applicable.
CANCELLATION/CHANGE POLICY: Please refer to the Airbnb ‘Strict’ cancellation policy. If Property becomes unavailable for any reason, all monies returned in full to Guest, with no further liability opposed upon Owner. Owner will not be in breach of the terms of this agreement if the cancellation by Owner is beyond reasonable control including and without limitation to a change in ownership of the property, a damage or malfunction of equipment, disturbances on nearby properties, construction in or adjacent to the property, labor disputes, governmental regulations or controls, fire or other casualty, holdover tenants from a previous rental, inability to obtain materials or services, technical failure or difficulties, problems or interruptions with the internet or television, computer viruses, acts of god, insurrection, terrorism, or any other cause.
SECURITY DEPOSIT: The Security Deposit may be used by Owner, at their sole discretion, to pay for restoration of the Property to move-in conditions (“additional costs”), other than for normal wear and tear. Additional costs include, without limitation, cleaning beyond normal wear and tear and not covered by the cleaning fee, missing properties, removing excessive garbage, repairing or replacing any part of the premises, its contents, common areas and recreational facilities for damage caused after Guest check-in. In the event that security deposit is insufficient to cover Additional Costs, Guest agrees to allow Owner to charge Guest for the additional costs.
INSURANCE: We encourage all guests to purchase traveler insurance.
LIABILITY: You agree to indemnify and hold harmless the Owner from all liability, damage or loss to personal property or its contents that occurs during your stay resulting from any cause, including but not limited to negligence, violation of any law, carelessness, neglect, theft or improper conduct of any persons entering, occupying or visiting the rented premises. Owner is not responsible for any personal property of Guest or guests’ that is/are lost, stolen or left behind, including vehicles, which are not insured by the Owner against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others or any other cause. Guest hereby indemnifies and holds the Owner free and harmless from any and all liability, claims, loss, damages, demands or expenses, including counsel fees and cost, arising (a) by reason of the death or injury of any person, including Guest or any person who is a guest or invitee of Guest, or (b) by reason of damage to or destruction of any property, including property owned by Guest or any person who is a guest or invitee of Guest, caused or allegedly caused by (1) any cause whatsoever while that person or property is in or about the Property or in any way connected with the Property during Guest’s occupancy; or (2) any matter connected with Guest’s occupation and use of the Property.
NO HOLD OVER/STAY OVER POLICY: If Guest holds over or remains on the vacation rental property beyond the specified Departure Date of this Rental Agreement, by Check out-time, unless otherwise approved by Owner, Guest agrees and consents to be removed from the premises and locked out of the Property by Owner, its representatives, and/or law enforcement. Guest further consents to permit Owner to remove Guest’s personal belongings to a location of Owner’s choice, where Guest can retrieve them.
NO SHOES POLICY: Please DO NOT WEAR SHOES inside the house in order to keep the home clean and sanitary. Slippers and sandals are provided for your convenience.
NO SMOKING POLICY: This is a NO SMOKING residence (inside and outside). No exceptions. Any evidence of smoking on the property will result in a fine of $500.00 from the security deposit and termination of the rental agreement.
NO PETS POLICY: PETS ARE NOT ALLOWED on the property (inside or outside). Any evidence of pets on the property will result in a fine of $500.00 from the security deposit and termination of the rental agreement.
PARKING: Parking is limited to one vehicle in the garage. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the Guest(s). No RVs allowed.
OWNER ACCESS: Guest shall allow Owner access to the property for purposes of repair and inspection. Owner shall exercise this right of access in a reasonable manner.
HOUSEKEEPING: There is no daily housekeeping service. While linens and bath towels are included, daily maid service is not included in the rental rate. There is a washer/dryer to clean your personal clothing. Towels and/or linings taken from the premises will be deducted from the security deposit.
REPAIRS AND MAINTENANCE: Owner cannot guarantee against mechanical failure of heating, air conditioning, appliances, TV, DVD/streaming player, stereo, pool/spa, etc. Guest agrees to report any inoperative equipment to Owner promptly. Owner will make every reasonable effort to have repairs done quickly and efficiently.
CLEANING: A non-refundable exit-cleaning fee is required to reserve our home. We ask that guests treat the home with care, leaving the Property in the same condition as found upon your arrival. Within the first hour of arrival, if you are not satisfied with the cleaning, please contact us at the number provided, so that we can attend to your specific requests.
UTILITIES: All utilities are included in the rental price.
FIREPLACE: The fireplace is a gas fireplace only. Please do NOT use wood or any other combustible materials in the fireplace.
WATER: Guest is advised that the property is located in a desert environment and water is a scarce and costly resource. Guest hereby agrees to help conserve water as much as possible. Additionally, the water in the area has a higher concentration of calcium which can cause mineral deposits on fixtures and all surfaces.
PLEASE WIPE OFF EXCESS WATER ON SHOWER TILES, GLASS, FIXTURES, TUB, COUNTERS AND SINKS AFTER USE.
POOL/SPA: There is no lifeguard on duty. You are responsible for the pool safety of yourself, your children and your guests. The pool is accessible from the home without a fence and there is no alarm on any door to the pool area. Your attentive personal supervision is absolutely required to avoid risk of serious injury and/or death. Children are not permitted to use the pool/spa unless supervised by an adult. No diving or running is allowed in or around the pool and/or spa.
Pools and spas are a serious safety risk and hazards; including serious injury or death could result if not used with attentive care and caution. You hereby acknowledge, and are aware of and assume these risks for yourself, your party and for any guests or invitees who are on the Property during your rental term. Owners are not responsible for accidents. You agree to release, indemnify and hold harmless from any and all liability (active or passive) the Owner for any harm or injury caused by using the pool and/or spa and equipment. You hereby agree/accept that pools and spas contain necessary chemical that can cause skin rashes, harm or discoloration of swimwear. You and your guest and invitees agree that you use pools and spas completely at your own risk. The pool service company maintains the pool and equipment twice weekly. Please do not change the equipment settings at any time.

USE OF THE PROPERTY: Guest shall use the property for legal purposes only and any other use such as but not limited to illegal drug use, abuse of any person, harboring fugitives etc., shall cause termination of this Agreement with no refund of rent or deposit. Guest accepts responsibility to properly maintain the property during occupancy and agrees to pay for repair/replace and for any breakage, damage, or loss caused by Guest or Guest’s visitors during occupancy. Guest must notify Owner in writing, via email, of any accidental damage to the Property during their occupancy.
NO EVENT/PARTY POLICY. No celebrations, weddings, reunions, parties or other events (collectively “Events”) are to be held at the Property during Guest’s occupancy. Holding an Event without prior Owner approval will be considered a breach of the Terms and Conditions and cause for immediate termination of Occupancy and Guest will forfeit all monies, including security deposits.
NO ASSIGNMENTS OR SUBLETTING: Occupant shall not assign any interest in the Agreement or sublet any part of the property. Any attempted assignment or sublet shall be void and ineffective and shall result in immediate termination of the Agreement and occupancy of the Premises. In the event of such termination, Owner shall be entitled to retain all sums paid by Renter.
AMENITIES: Owner provides all linens, towels dishes, cups, knives, forks, spoons, cooking utensils and other items as commonly used during a rental. Owner also provides a reasonable amount of paper towels, toilet paper, hand soap, dish soap, laundry soap and other consumables. Additional quantities of these items should be purchased by the Guest as necessary. There will be no reimbursement made for any unused consumables left on the property. If there are any consumables on the property when the Guest arrives, the Guests are free to use them.
Guest(s) will be requested to sign a Rental Agreement.
