This beautiful community is right across the road from the Bayside Resort community and it is called Arrington Woods. There are 4 bedrooms (2 Master Bedrooms), a family room and loft area with sleeper sofas, 4 Bathrooms (3 full and 1 half, and the Master Bedroom has a soaking tub as well!), 9 foot ceilings, fireplace, and it is all brand new and very modern. This is a luxury vacation home with over 2700 sq feet of luxurious living space. 3 of the 4 bedrooms have King sized beds. This community has an awesome swimming pool as well! *****Peak Season Variable Stays******** We generally do Saturday to Saturday rentals in the summer. However, we can do partial weeks, if you can do one of the 2 options below:

OPTION # 1 - If you do not want a full week you can do a Saturday check in or a Saturday check out with a 3 or 4 night minimum (depending on the week and what is already rented).

OPTION # 2 - For a stay over a weekend (includes a Friday and Saturday Night stay), there is a 5 night minimum (because it breaks up 2 full week rentals that normally run Sat to Sat). There are some exceptions here as well depending on availability and other rental dates.

***Pricing for partial week will vary and potentially be higher depending on which nights, number of nights, etc... Please let me know if either of these options work for you, and if so, I can send you a rental agreement and get your reservation started. Thanks!

***Bring our own Towels and Linens*** There is an optional Linen Drop Off service available for $19 / bed which includes bed linens, 2 bath towels, 2 wash cloths, and 2 hand towels / bed for $19 / bed. Please contact owner at least 1 week in advance to get this service.

3) THE LIDs MUST SHUT COMPLETELY - The trash cans cannot have so much trash in them that the lid does not shut. If you have that much you must take it somewhere and dispose of it. Or, You can call and let me know, and I can have my cleaning company come by and pick up the excessive trash and take it away. IT JUST NEEDS TO BE NEATLY BAGGED so they can take it in their car.

4) RECYCLING PICK UP is every other Tuesday (PHONE NUMBER HIDDEN), etc...

• Trash pick up day is now Tuesdays, so you can roll the can out on Monday night (if you are there on a Monday Night).

Bicycles - ALL bike riders must wear a helmet, you must bring your own helmet (and air pump for tires). You are welcome to use our families bicycles that are there at your own risk. When renting this unit, you are accepting all risk and liability if you choose to use our bicycles instead of bringing your own. Again, in DE helmets must be worn or you are subject to getting fined. YOU MUST BRING YOUR OWN HELMETS. Also a good idea to bring an air pump for the tires in case they get low. Enjoy!

There are many stores and restaurants right in the immediate area. Harris Teeters is a gourmet grocery right across the street from the community which also has an ice cream store, pizza / sub shop, bank and other stores and restaurants. There is also a CVS, McDonalds, Food Lion Grocery and several other stores, restaurants and services in the area. Our favorite Mexican Restaurant is Cactus Cafe which is just 1/4 mile away!

The terms of this Agreement are as follows:

4) No other people allowed on property other than those on this contract above _______________(initial)

THE CONDOMINIUM

In consideration of the rent payment to be paid by Tenant and of the other covenants and agreements herein contained, the Landlord rents to Tenant the Condominium.

Tenant shall use the Condominium only for residential purposes. Tenant shall not use or allow the use of the Condominium in any way that interferes with other tenants’ use and enjoyment of the Condominium or neighboring property. Tenant shall not use the condominium for any illegal or improper use. Additionally, Tenant shall comply with all zoning Ordinances, Protective Covenants and deed restrictions.

The Condominium includes 4 bedrooms; 3 1/2 bathrooms. Beds are 2 King beds, 1 Queen Bed, and a bunk bed + a Queen Sleeper and a twin day bed in the loft.

Parking is available with the Condominium. Spots are available on a first come first served basis.
ALL CANCELLATIONS MUST BE IN WRITING. In the event of a cancellation, 16% of the gross rental will be charged if the property is re-rented for the full amount. If the property is not re-rented for the full amount , the rental deposit will be forfeited. For cancellations within 30 days of arrival, the forfeited deposit will equal one-half of the grossly week rental amount collected. For cancellations in excess of 30 days prior to arrival, the forfeited deposit will equal one-third of the gross weekly rental. A non-refundable processing fee is charged on each reservation. If tenant has not checked-in within 24 hours of the arrival date, the reservation may be cancelled and all rental monies forfeited. No refunds will be given for inclement weather, including hurricanes, or for activities beyond the control of the owner.

TENANT RESPONSIBILITIES
The Tenant shall comply with all obligations imposed upon tenants by applicable provisions of building, housing, and health codes, maintain the Condominium in good condition during the entire length of this Agreement and shall neither cause nor allow any abuse of the facilities therein.

The Tenant acknowledges that they are responsible for any and all damages that occur during their rental period whether caused by themselves or their guests and agree to pay for all damages, plus court costs and reasonable attorney fees incurred in collecting damages from the tenant.

The Tenant covenants and promises to surrender property in as good or the same condition as the commencement of occupancy, reasonable wear and tear expected. Any pre-existing damage must be reported by Tenant within 24 hours of taking occupancy. Owner shall have the right to inspect and make repairs to property during the lodging period and will inspect property at the conclusion of this Lease Agreement. If property becomes uninhabitable by reason of fire or other casualty not caused by the negligence of Tenant, his family, or his guests, the Lease Agreement hereunder shall be terminated and Tenant shall be entitled to a pro-rata refund from Owner.

Tenant agrees to pay an excessive housekeeping fee if Property is not left in the following condition:
Remove all food from refrigerator and all trash from property. b) Clean dishes and cooking utensils and properly store them. c) Make beds. d) Leave furniture arranged as it was found. e) Check all drawers and closets for items left behind. f) Close all windows and lock the doors when leaving. Tenant is responsible for Property until all keys, pool tags and parking permits are returned and property is vacated.

Toilets shall not be used for any purpose other than that for which they were constructed and no sweepings, sanitary products, diapers, rubbish, rags or garbage shall be placed therein. Any stoppage of sewage lines caused by abused shall be repaired at the expense of the Tenant. Tenant will reimburse owner for any damage caused by escape or overflow of water.

The Condominium includes the following amenities:
Fireplace, Swimming Pool, ,Jacuzzi Tub in Master Bathroom

APPLIANCES

The Condominium includes the following appliances for the Tenant to use

Washer, Dryer, Microwave, Stove, Refrigerator, Air Conditioning, Cable TV, Coffee Maker, Blender, dishwasher.

Furniture

The Condominium includes the following furniture for the Tenants use:

Sofa, Love Seat, Chair, kitchen table and chairs, bar stools, 2 king beds, 1 Queen Bed, 1 bunk bed with a trundle, dressers, end tables, 3 televisions, coffee table, Sleeper Sofa in Living room and twin day bed in loft, and other miscellaneous furniture.

CONDOMINIUM ALTERATIONS

Tenant shall make no alternations, additions, or improvements to the Condominium (including but not limited to the application of paints , stains, nails, screws to the woodwork, walls, floors, or furnishings) without first obtaining the express written consent of the Landlord.

INSURANCE

Tenant acknowledges that Landlord’s insurance does not cover personal property damage caused by fire, theft, rain, war, acts of God, acts of others, and/or any other causes, nor shall Landlord be held liable for such losses. Tenant is hereby advised to obtain his own insurance policy to cover any personal losses.

WEEKLY LODGING TERMS – IT IS UNDERSTOOD, MUTUALLY AGREED AND ACKNOWLEDGED BY THE PARTIES TO THIS AGREEMENT

Owner or agent may have access to property at any time, at their sole discretion, for the purpose of inspection, maintenance or repairs.
Owner may terminate this Agreement and remove Tenant at any time, if at the sole discretion of Owner, Tenant becomes objectionable, violates any of the terms of this agreement or violates any of the property rules and regulations. In such events, Tenant agrees to immediately vacate property without refund, and owner shall not be liable for any damages, including, without limitations, incidental and consequential damages.
No relation of Landlord/Tenant shall exist or be deemed to exist by virtue of this Agreement of Tenants occupancy of property hereunder.
The validity and construction of this Agreement and all questions arising hereunder or relating to the performance hereof shall be determined and governed by the laws of the State of Delaware. The parties hereto agree that any action brought by either party arising out o this Agreement, or to enforce this Agreement shall be brought in Sussex County, Delaware. The parties hereto ach specifically waive any venue, except as set forth above.
If for any reason whatsoever Tenant is denied access to subject Property, and is thus unable to take possession thereof by the time prescribed, Owner’s liability shall be limited to the return to Tenant of all monies paid on account. Tenant hereby agrees to hold and save harmless the owner, from damages or injuries to persons or property by reason of any cause whatsoever either in or about the property or elsewhere.
If Tenant chooses not in inspect property prior to signing this agreement and paying a deposit, tenants agrees to accept property as is on arrival and tenant will not be entitled to a refund of rent money and will have no claim or recourse against owner.
Tenant agrees to hold, defend and save harmless Owner from damages or injuries to persons or property either in or about property.

In addition to the rights provided by the laws applicable to the State of Delaware, the Landlord shall have the right to enter the Condominium at all reasonable times for the purpose of inspecting the and/or showing the same to prospective tenants or purchasers, and to make such reasonable repairs and alterations as may be deemed necessary by the Landlord for the preservation of the Condominium or the building and to remove any alterations, additional, fixtures, and any other objects which may be affixed or erected in violation of the terms of this Agreement. The Landlord shall give reasonable notice of intent to enter Condominium except in the case of emergency.

RULES/RESTRICTIONS

No reduction of rent, rebate or refund will be issued for any mechanical failure of air conditioning, dishwasher, washer, dryer, T.V., or other appliance or deficiency. Upon prompt notification by Tenant, owner will make every effort to have such appliances, air conditioners or the items repaired or corrected. REPLACEMENT OR REPAIR OF TELEVISIONS, VCR’S, DVD’S AND MICROWAVES, CANNOT BE GUARANTEED.
The property shall not be used for any commercial purpose or for any activity or purpose that is in violation of any regulation, or other requirement of any governmental authority having jurisdiction over property. Tenant agrees to abide by the building’s rules and regulations. No barbecue type cooking is permitted on the property, including balconies. The number of parking spaces varies by building. Some buildings cannot accommodate oversized vehicles and alternate parking is not provided for them. Owner is not responsible for illegally parked vehicles. Boat trailers, or any other type of trailers, are not allowed on premises.
Tenant must provide own linens, towels, paper products, and soap.
Tenant acknowledges and agrees as follows: Selbyville,, DE has adopted a Noise Control Ordinance that makes it unlawful to cause or permit noise levels which exceed t hose established by the Department of Health and Mental Hygiene of the State of Delaware. It shall be a violation of this Agreement and grounds for immediate eviction if these noise levels are exceeded as a result of Tenants activity on property. Selbyville, DE has other noise ordinance which are civil/ or criminal offenses if violated.
Owner reserves the right to cancel this Agreement at any time prior to Tenant taking occupancy of property. In such event, Owner will refund to tenant all deposit monies received.
There will be a $100.00 fee for lockouts, payable when tenant is admitted to the property.
Opening and closing of pools is at the discretion of each individual building. Owner is not responsible for closed pools or other common element problems.
Owner is in responsible for theft or Tenants belonging left in property.
No representation, agreement, undertaking or promises, whether oral, implied or inferred have been made by either Owner or Tenant unless expressly stated herein.
NO SMOKING.

POSSESSION AND SURRENDER OF THE CONDOMINIUM

At the expiration of the Agreement Term, Tenant shall immediately surrender the Condominium to the Landlord in the same condition as at the start of the Agreement, reasonable wear and tear elements expected. The Tenant shall return a complete set of keys to the Landlord and provide in writing, the Tenant forwarding address. If any Tenant remains in the Condominium in or after the expiration or termination of this agreement without the Landlord written permission, the Landlord may recover possession of the Condominium in the manner provided for by law.

ABANDONMENT

Abandonment is defined as the absence of the Tenant from the premises for a period of seven (7) or more consecutive days while rent or any owing monies remains unpaid – whereupon Tenant will be considered in breach of this Agreement. If Tenant abandons the Condominium during the term of this Agreement, the Landlord may enter the Condominium by any legal means, without being liable for such entering, and without becoming liable to the Tenant for damages caused upon entering. Landlord may consider any personal property belonging to the Tenant and left on the property to also have been abandoned, in which case the Landlord may dispose of all such property in any manner the Landlord deems proper without becoming liable to the Tenant for doing so.

The Landlord may at its option terminate the Agreement and re-let the Condominium, and may receive and collect all rent payable by virtue of such re-letting. Had this Agreement continued in force, the Landlord may hold the Tenant liable for any differences between the rent that would have been payable under this Agreement during the balance of the unexpired term and the net rent for such period realized by the Landlord by means of the re-letting.

LEGAL FEES

If the Tenant is in breach of this Agreement, and the Landlord finds it necessary to enforce this Agreement, or collect rental or other damages, through an attorney or in a legal action, the Landlord shall be indemnified by the Tenant for any reasonable attorney’s fees and out of pocket costs which in any way relate to , or were precipitated by the breach of this Agreement by the Tenant.

WAIVER

The Landlord’s failure to enforce or enforce on compliance with any provisions of this agreement shall not be deemed a waiver nor a limitation of the Landlord’s right to enforce or insist on compliance with the provisions of this Agreement.

BINDING EFFECT

Except as otherwise provided in this Agreement, all of the covenants, conditions, and provisions of this Agreement shall apply to and bind the parties and their heirs, personal representatives, successors, and assigns of the parties.

17) HEADINGS

Headings are inserted for the convenience of the parties only and are not to be considered when interpreting this Agreement.

ASSIGNMENT, SUB-LET, AND LICENSE

The Tenant shall not assign this Agreement, or sub-let or grant any license to use the Condominium or any part thereof without the prior written consent of the Landlord. Consent by the Landlord to one such assignment, sub-letting or license shall not be deemed to be a consent to any subsequent assignment or sub-letting by operation of law shall be absolutely null and void and shall, at the Landlord option, terminate the Agreement.

AMMENDMENT OF AGREEMENT

Any amendment or modification of this Agreement or additional obligation assumed by either party in connection with this Agreement will only be binding if evidenced in writing by both parties.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supercedes any prior written or oral covenants or representations relating thereto and not set forth herein shall be binding on either party hereto. This Agreement may not be amended, modified, extended, or supplemented except by written instrument executed by the Landlord and Tenant. The Landlord has made no representation or warranty to Tenant except as herein expressly set forth.

SEVERABILITY

Should any conflict arise between any party of this Agreement and the applicable legislation of the State of Delaware, the State Laws will prevail and such provisions of the Agreement will be amended or deleted as necessary in order to comply with State Laws. Furthermore, any provisions that are required by State Laws may be subsequently incorporated into this Agreement.

In the event that any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, those provisions to the extent enforceable and all other provisions will nevertheless continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement.

My first airbnb and it was great. The house is bigger than the picture. Take a left you're at Fenwick island, take a right you're at ocean city. Great location and the owner response time is fast. I think he works for 911 je responds so fast. Would go again.
