RULES (LEASE) for Guests/Tenants
Guest/Tenant - Guest or Tenant of Apartment (Unit) #301 in Colonial Manor West
Landlord - Landlord and owner of Apartment #301 in Colonial Manor West or his representative.
Association - Colonial Manor West Condominium Association and any of its authorized representative, officer or agent such as management company.
Subject: Guest/Tenant rents Apartment #301 in Colonial Manor West as a vacation rental under the terms displayed below and terms and rules of a Landlord's partner or intermediary like online platforms and sites, if any, paying the rent to Landlord directly or indirectly in the amount and for a term agreed by parties before check-in.
Please, pay special attention to highlighted text!
In case of self-check-in Guests/Tenants when arrived must check in by notifying Landlord within 1 hour after coming into the apartment via text, email or through the site which you used to reserve the unit.
Smoking inside of the apartment is strictly prohibited, smoking is allowed outside only and please pick up butts. Guest/Tenant may lose the deposit in case violation of this rule.
3. APARTMENT & BUILDING APPEARANCE & MAINTENANCE:
a). To maintain the high caliber of the exterior appearance of our building and grounds, It is prohibited to hang garments, towels etc. from the windows or facades of the building or over the side of the balcony, anywhere outside the apartment except the inside of the apartment's balcony.
b). Don't place personal items (chairs, tables, decorations, garbage, packages etc.) or objects of any kind on the public walkways or in other common areas and facilities of a similar nature.
c). While Guests/Tenants are out of the apartment, all the lights, TV-sets and other appliances except refrigerator, AC and water heater must be turned off.
d). Guests/Tenants must use the appliances in the right way (don't leave the refrigerator door open when it is turned on etc.).
e). Guests/Tenants must keep windows and doors closed all the time while AC is working not letting warm air inside the apartment.
Residents shall exercise extreme care about making noise, or the use of musical instruments, radios, television that may disturb other residents.
No boisterous conduct or unreasonable noises are permitted. Yelling and screaming by children should be curbed by parents or their responsible adult. Play musical instruments, TV, radios, stereos, etc. all at a moderate level. Exterior cell phone conversations should be moderated and not disrupt others.
Please make certain the gates close and latch when entering or leaving the complex. Also, please close the gates quietly. Do not let them slam.
No nuisance, use or practice shall be allowed on the property which is a source of annoyance to the other residents. All parts of the property shall be kept clean and sanitary, and no rubbish, refuse or garbage allowed to accumulate, nor any fire hazard allowed to exist.
6. SWIMMING POOL RULES:
The pool shall be used only by residents and guests during such hours and under such conditions which will not annoy other residents.
Pool Hours: 7:00 AM - 9:00 PM
a). Pets are not permitted in pool area.
b). No glass is permitted in pool area.
c). All pool lounge chairs must be covered with beach towels when sunbathing.
d). Remove all personal items such as towels, floats, lotions and trash when you leave the pool area.
e). If you move the pool furniture, put it back when you leave.
f). Lower pool umbrellas when you leave the pool area.
g). Shower before entering pool, using the pool shower for your convenience.
h). Children under 12 must be accompanied by an adult at all times.
i). All persons using the pool do so at their own risk.
j). No person shall conduct himself in such a manner as to jeopardize the safety of him/herself or others.
k). Bathers must leave the pool during thunder and lightning storms.
l). One raft at a time is permitted in pool because of the size of said pool. Other people must be able to swim freely.
m). No articles shall be thrown in the pool or pool area.
n). No diving, running, jumping or games, etc. allowed in pool or pool area.
o). Management reserves the right to deny the use of the pool to anyone at any time for violation of any rule.
7. TRASH, GARBAGE AND PLUMBING:
It is prohibited to throw garbage or trash outside the disposal installations provided for such purposes.
Place recyclables in the containers on the east side of the building and garbage in the dumpster. If the recyclable cans are full, then use the dumpster for those excess items. Do not overfill them.
Our plumbing system is old and heavily corroded. As a result, items other than toilet paper can easily catch on the rough plumbing and clog the system. Never flush diapers, tampons, sanitary napkins, condoms, baby wipes, paper towels, or other items not intended to be flushed.
8. OVERNIGHT GUESTS and MAXIMUM OCCUPANCY:
Overnight guests (present after 10.00 p.m.) of the Guest/Tenant in the property not authorized by Landlord is the sole responsibility of Guest/Tenant and may be removed by Landlord.
According to Ordinance of City of Fort Lauderdale No. C-15-29, Sec. 15-278, Paragraph 2, The occupancy of this apartment (which living area is 790 Sq.Ft) must not exceed 4 persons.
Guest/Tenant must get a written approval from Landlord to quantity of people living in the apartment.
Guests/Tenants must assume full responsibility for the care and protection of children brought onto the grounds or into the building, either by themselves, or by their guests. Guests/Tenants are fully responsible for any damage that may be done by the children. Children are not permitted to run up and down stairs and balconies, or in any way interfere with the quiet and comfort of the residents. They may not yell, scream and be noisy at their play.
Guest/Tenant must park his/her car only in the spot #22 assigned to the unit #301.
Residents, Guests/Tenants are not permitted to park in our Guest Parking spaces. Those parking spaces are temporary parking spots reserved for car washing, deliveries and visitors.
When using the laundry room, turn off the lights when done and close the door. Also, clean out the lint trap after your use of the dryer. Don't leave clothes in the washer or dryer for long periods as others may be waiting to use the machines.
If the machines malfunction, please call MacGrey (their number is listed on the wall of each laundry room). The Association does not maintain the washers/dryers and is not able to fix them or refund any lost money.
Pets are not allowed.
13. RIGHT OF ENTRY IN CASE OF EMERGENCY OR REQUEST:
An owner shall grant the right of entry to the management agent or to any other person authorized by the Board of Directors or the Association in case of any emergency originating in or threatening his unit, whether Guest/Tenant is present at the time or not.
An owner shall permit other owners, or their representatives, when so required, to enter his apartment for the purpose of performing installations, alterations or repairs to the mechanical or electrical services, provided that requests for entry are made in advance and that such entry is at a time convenient to Guest/Tenant.
14. VIOLATIONS, RESPONSIBILITY, RULES ENFORCEMENT and LOSS OF DEPOSIT:
a). According to Ordinance of The City of Lauderdale No. C-15-29, Sec. 15-273, Paragraph (5)e,
Guest/Tenant acknowledges that he/she may be evicted for violation of these rules (lease) and:
That if he/she, without being authorized or invited, willfully enters or remains in the structure or conveyance of the property, or, having been authorized or invited, is warned by Landlord to depart the property and refuses to do so, commits the offense of trespass in the structure or conveyance.
b). Violations of rules by Guest/Tenant and children will be the Guest/Tenant’s responsibility. If sanctions for such violations are imposed on the Landlord and if necessary, enforced in a court of law with all related administrative, attorney and court costs, the violating Guest/Tenant must reimburse all expenses incurred by the Landlord including expenditures incurred in repairing or replacing any elements and facility damaged through Guest/Tenant's fault.
c). Guest/Tenant may forfeit deposits for breaking the rules and any damages suffered by Landlord and caused by the Guest/Tenant.
d). The owner is not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The owner is not responsible for the loss of personal belongings or valuables of the guest/tenant. It is agreed that Guests/Tenants are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
