House is in a quiet and friendly neighborhood. The house has a lanai with a pool bar that has a TV. The lanai looks out over a large solar heated pool and a Gulf access canal with a boat dock. Additional charge of .15cents/Kilowatt hr. used
Basis of the contract are only the data, descriptions and conditions of the house rules, which are valid at the date of booking for the travel period. Special wishes can be fulfilled, as far as it is possible, but further inquiry with the owner is needed. The tenant takes responsibility for its own contractual obligations and for all listed persons in the contract. The contract becomes obligatory by signature.
2.Range of the renting relationship:
The renting relationship covers the object, as it is indicated in the advertisement. The renting object may be occupied only with the number of persons indicated in the contract. Persons in addition to the permitted number require the express permission of the owner and the written confirmation. If the number of people exceeds the number of persons which are indicated in the contract, the owner has the right to reject surplus persons or to require for these a surcharge. Special agreements are valid only with written confirmation.
The minimum renting duration amounts to 1 week. During the Christmas and Easter Vacation it is 2 weeks. Prolongation on a daily basis is possible. The daily price corresponds to 1/7 of the week price.
4.Pre-payment and Final-payment:
With the receipt of the rental contract a down payment becomes, at height of 25% of the renting sum due, payable within 14 days after signature. For the receipt of the down payment you will receive no further confirmation. The remaining sum must be paid 4 weeks prior to arrival in Florida to us. For short-term bookings, I.e. 30 days before arrival, the total rent is payable immediately. The security deposit of 500.00 US dollars is also payable with the final payment. Cost of damages may be paid with it. Damage caused by tenant goes to your expenses. The refund of security deposit (without interest) effected within 30 days of the rental period if there are no objections.
5.Price structuring/additional expenses:
The prices are per property for the duration of the rental property. The price includes the costs of water, waste collection fees, costs for the pool service and gardening, property management, telephone, internet access (with your own computer), cable TV, final cleaning and 11% tax. Only the costs of electricity, which is directed by the consumer, are extra.
Additional costs: The costs of electricity amounted at 0.15 ct/kwh. The electricity meter is to be read by the property manager on arrival and departure.
The final cleaning: includes a regular cleaning of home and laundry. Should additional cleaning, e. g. Of the carpets or grill cleaning, be necessary, the tenant will be charged. Cleaning efforts exceeding the average may be charged to tenant. The grill must be cleaned by the tenant.
6. Cancellation and early termination:
If the tenant terminates the contract before the rental period starts and doesn’t name a replacement that accepts the same terms, then they are responsible for paying the following percentages of the rental price to cover costs (excl. cleaning), as long as a further rental is not possible:
Up to 91 days before rental period 25% of rental price
Up to 90-31 days before rental period:50% of rental price
Up to 30 days before rental period:100% of rental price
The owner can thereafter let the property to someone else. The tenant can prove a lesser damage at any point.
If the tenant terminates their stay early, they are still responsible to pay the full rental price. Termination is only accepted in writing. The date applicable is the day the document id received by the owner.
During grant of special prices the above mentioned cancellation fee regulation loses its effect. Cancellation from the booking with granted special prices always causes a cancellation fee of 100% of the rent.
We strongly recommend the closing of a travel resignation cost insurance!
7. Obligations of the tenant:
The tenant has to treat the rental property with care. Renters are expected to regularly clean the property during their stay. Any kind of inventory in the house is the personal property of the owner and is only made available to the tenant. If the tenant take such things away they will be charged to him. The tenant is obliged to report any damage incurred during his tenancy to the owner or property manager and to pay on the spot. If other trouble occurs the tenant is also obligated to inform the property manager to make sure that troubleshooting is possible. The tenant undertakes to do everything reasonable to contribute a fix for a problem and limit the possible damage caused. Authorized personnel of the property management have access to the house for repair work and maintenance.
Tenants are liable for any damages cause by them to furniture, carpets, walls, technical equipment etc…
In particular, it must be ensured, especially in the summer months, doors and windows be kept closed when the air conditioner is turned on in the house.
We expressly point out that you live in a purely residential neighborhood with Americans who are living their normal everyday life, and not a club or resort, as known from conventional travel offers.
Smoking is not permitted in the house. You’re welcome to smoke on the patio and the outside areas.
Of any kind are prohibited in the house. Pets are permitted only with written permission from the property owner. With offence the tenant has to leave the house immediately. In addition, all costs which are relating to this breach will be charged to the tenant.
10. Arrival and departure:
Keys can be exchanged by the property manager. Check in is after 4:00 PM and check out by 11:00 AM, unless otherwise agreed in writing. A late check-out fee will be charged if renters do not move out on time.
We are responsible for the careful preparation of the house and the careful execution of reservation. If due to force majeure or other serious reasons the rental property cannot be made available, we reserve the right to offer the tenant a possible alternative accommodation. If the tenant does not agree with the alternative house or no equivalent replacement may be offered, both sides have the opportunity to terminate the contract. In this case, our liability is limited to reimbursement of amounts paid. Any further claims are excluded in particular due to force majeure (natural disaster, bugs-plague, riots or strikes). Similarly, unforeseen and unavoidable circumstances such as administrative orders, construction sites, noise from the neighbors or the occasional loss of power supply.
The tenant and any accompanying persons which use the house and all furnishings as well as the pool, do that at their own risk.
If the tenant or any accompanying person will be harmed through the use of the house or furniture there is no liability from the side of the owner. The outdoor paving in the patio area can be slippery when it is wet through pool or rainwater. The tenant undertakes to inform all persons traveling with him to this fact.
Parents are responsible and liable for their children. The use of the pool by children must only be done under the supervision of parents. Similarly the stay at the dock.
If the property has any issues the tenant feels need to be addressed, he must contact the property manager immediately so that the issue can be resolved otherwise the tenant is responsible for these damages. If the renter fails to notify the manager during his stay of any problems, it will not be possible to put in any claims later. For the removal by damage an appropriate period must be granted. Any complaints received at the end of the stay or to leave the rental property, is entitled to any compensation. Tenants who leave the accommodation prematurely lose all entitlement to a refund of the rent. Construction in the area around the rental property is not considered an issue that might lead to a price reduction or refund.
13. Other terms and conditions:
The pool service has access to the pool area through the screen doors in the pool cage. Please leave these doors unlocked. The pool is serviced once a week. The lawn care has access to the garage and the yard. The lawn is mowed every 1-2 weeks depending on the season.
14. Final clauses:
The rental agreement as well as the terms and conditions are subject to private law. Travel laws do not apply when booking this home. We expressly point out that we are not a travel agent.
15. Place of jurisdiction:
Is the residence of the house owner.
16. Salvatory Clause:
If one of the terms is invalid or unenforceable, the other terms and conditions are not affected and remain valid. The invalid term is replaced with the terms and conditions as per law. The authorization of errors and typographical and calculations errors are reserved.

Hi we are Pam and Gus Neidrich, we recently bought this great home in beautiful Cape Coral, Fl, which will be our snowbird home when we retire. Pam is a flight attendant and I am a RN. We have traveled to many places and we love Cape Coral. We love the house because it is in a really friendly neighborhood, has a nice large pool, and on a canal that goes out to the Gulf of Mexico.
