You will be the only guests staying at our home. Access to the apartment is from our backyard. The back porch is also yours to enjoy for sitting and sipping on a cold or hot beverage, swimming or just relaxing in the jacuzzi.. This is one of the favorite places of all our guests to enjoy and relax.

Our home is one of the most recognized historical homes in Texas. Built in 1893 by a prominent architect from Virginia, James Riely Gordon. Gordon designed hundreds of buildings including 18 Texas Courthouses and the Arizona State Capitol. Gordon combined the arches and colors found in Moroccan design and Queen Anne style architecture to design our home. John and Gina are happy to share more about their home and the history of the neighborhood. Our home regularly appears in magazines, calendars, special San Antonio promotions, and HGTV . It is considered one of the gems of our city. You have access to the RiverWalk from just behind our home. The pathway along the RiverWalk extends towards the missions one way and downtown the other way.

VACATION RENTAL AGREEMENT

This occupancy will be in the form of a Vacation Rental only and not constitute a permanent of primary residence or other tenancy.

Pets are not allowed unless you have prior authorization. All pets must remain locked up in a cage when the owner is not at eh house. Tennant agrees to pay all damages caused by pets.
The Following are the specifics of this agreement:
Cleaning of the house before departing
Tennant is responsible for cleaning the kitchen, dishes, refrigerator, taking all the trash out including bathrooms, cleaning the back porch and the kitchen\dishes. Tennant is also responsible for washing the blue and white towels and drying before departing. If this is not completed, then we reserve the right to withhold part or all of the deposit.
SECURITY: Security deposit is required in the amount of $150.00 USD and is due before acceptance of the reservation. Security will be held in a non-interest bearing account. Applicable security will be returned to the TENANT within (14) days after termination\departure of this agreement.
All or part of the security may be withheld in the event of property damage. The TENANT will be notified within 14 days of vacating the property as to the amount withheld and the reason. The security deposit shall in no way be used a rental payment.
CHECK-IN/CHECK-OUT: The check-in time is 4:00 PM. The checkout time is 10:00 AM. TENANTS agree to such time periods so the property can be properly cleaned for the next guest.
CANCELLATIONS: Cancellations must be made in writing. As the OWNER, I will refund cancellations 30 days prior with a 30% processing fee. For Air Force graduates I will move the date forward or back or attempt to place you at another property for the same price. If I cannot do either then I will refund 100% of your money( 100% refund is only intended for AIR Force Graduate Families..
ADDITIONAL CHARGES: All “normal” utilities are included. TENANT will be charged additional fees for the following:
• Long Distance phone charges
• Fines or summons imposed by Bexar County ( San Antonio,TX ) as a result of your actions
• Any damage to the house, garage or contents
PETS: There shall be no pets allowed on the premises.
GUEST/PARTIES/NOISE: The TENANT must supervise Guest(s) while on the premises. Noise in the house must be kept a reasonable level as not to cause a disturbance to the neighbors or general public. In no event may the maximum occupancy (as listed on the agreement) be exceed without written consent.
NO SMOKING POLICY: No smoking is allowed inside of the house whatsoever. Occumants will be removed immediatelt. If they are found to be smoking inside the residence.
MAINTENANCE: It is expected that major systems in and around the Home will break down from time to time such as air conditioning, washer, dryer, refrigerator, etc. OWNER will attempt to repair the problem as soon as possible upon notice by TENANT. OWNER assumes no liability to TENANT if such should occur as all products have a useful life and break down occasionally.
ILLEGAL DRUGS: Under no circumstances shall any illegal drugs be allowed on the property. TENANT understands that possession and use of any such substance is grounds for immediate eviction and forfeiture of payment. TENANT further waives any and all rights to recourse against the OWNER for enforcing this clause.
TENANT RESPONSABILITIES: All occupants are required to perform “Normal” household duties that include, but are not limited to:
• Garbage removal
• Notification of OWNER of any damages or problems with the property
• Locking of all doors when TENANT leaves the house
SUBLETTING/ASSIGNING/OCCUPANCY: There shall be no subletting of the premises. The TENANT shall occupy and use the premises as a vacation rental only and not use the premises for any business, professional, unlawful or hazardous purpose.
REPAIRS: The OWNER must be notified immediately if you discover any item that needs attention. Once notified, I will correct the problem.
SURVIVAL: If any clause or term in this lease is contrary to law, the reminder of the Lease shall remain in full force.
END OF TERM: At the end of the term, the TENANT shall leave the premises clean and in good condition, remove all TENANT property, repair all unreasonable damages caused during their stay.
HOLD HARMLESS AND INDEMINTY: OWNER of rental property shall not be liable for any damages and/or injury to TENANT and/or their guest(s), or their personal property due to TENANT’S acts, actions or neglect. TENANT agrees to hold OWNER harmless against any claim for damage and/or injury due to TENANT’S act or neglect or TENANT’S guest act or neglect. Tennant agrees to pay all attorney’s fees. Arbitration is binding and the arbitrator is choosen by the owner of the property and the location.
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of San Antonio Texas.The arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all conclusions of law and fact and shall include the assessment of costs, expenses, and reasonable attorneys' fees. Any such arbitration shall be conducted by an arbitrator experienced in [Short Term Housing Rentals] and shall include a written record of the arbitration hearing. The parties reserve the right to object to any individual who shall be employed by or affiliated with a competing organization or entity. An award of arbitration may be confirmed in a court of competent jurisdiction.Tennant also agrees to pay all attorney or arbitration and associated fees.
OCCUPANTS: The occupancy of the house is limited to the number of persons listed on the lease. If TENANT and any and all guests are subject to immediate removal and forfeiture of their security deposit and rental payment.
QUIET ENJOYMENT: TENANT and their guests agree not to violate quiet enjoyment and privacy of the surrounding neighbors. OWNER is not responsible for the actions of other property owners in the area, as I have no control over their actions.
WEATHER / ACTS OF GOD: OWNER is not responsible for any weather conditions or acts of god or nature that happen during TENANT’S stay on premises and no refunds will be made.
CONSTRUCTION: I am not responsible for any actions of other property owners due to noise dust or anything related.
UNFORSCEEN CONDITIONS: If any unforeseen conditions or problems with the House arise prior to or during TENANTS stay, OWNER reserves the right to either refund TENANTS payment or pro-rate.
ACCESS: TENANT agrees to allow access to the house and property to OWNER and his agents upon 1 hour notice by telephone or in person. Agents include but are not limited to plumbers, electricians, rental companies, pest inspection, etc. OWNER reserves the right to inspect the premises and house interior upon 1 hrs hours’ notice to TENANT. TENANT agrees not to deny access. If TENANT refuges to allow access to OWNER of any agent designated by OWNER , the OWNER reserves the right to terminate the TENANTS vacation rental and tenet will immediate vacate the premises upon demand by OWNER and will forfeit the rental payment.
KEYS: Access to the property is provided by key or code. TENANT agrees to return the set of keys after departure. All extra sets of keys should be left on the kitchen counter.
LAWS: The Laws of the State of Texas (Bexar County) apply to all terms under the Agreement. Any dispute under this agreement shall be veined. It is expressly agreed and understood that this lease shall not be recorded in the County Clerks office.
LIABILITY: TENANT may be responsible and liable to OWNER for damages in excess of the security deposit for any damage or loss caused by TENANT or its guest.
BRENCH OF AGREEMENT: Failure of comply with any of the foregoing clauses and overall rules established by OWNER will subject you to immediate removal from House and forfeiture of all rental payments and security deposits. If TENANT fails for vacate the premises and the end of the rental period prescribed in this agreement, TENANT shall be charged and liable to OWNER for $300 per day for everyday past the day and time specified in this agreement.

Resident understands that the use of the swimming pool and/or spa/hot tub (where applicable) on the Premises (“Pool”) is a privilege, not a right. Said use of Pool by Resident may be restricted or revoked by Owner/Agent if Pool rules stated in this Addendum (“Rules”) are not followed. Resident understands that Owner/Agent reserves the right to deny access and use of Pool to any individual, Resident or guest, at Owner/Agent’s discretion. Resident understands that these Rules are created and enforced for the protection and benefit of all individuals and to assure safe and sanitary operation of Pool. These Rules will be posted at or around Pool and may be changed if necessary as allowed by law. The following Rules are required for Pool use: 1. Operating hours for Pool are as follows: These hours are posted at Pool area and may be changed or modified by Owner/Agent as allowed by law. 2. Use of Pool is reserved for residents and their guests only. Guest(s) must be accompanied by a resident at all times. 3. Resident agrees to acquaint all guests utilizing Pool with these Rules and insure that said guests comply with these Rules while utilizing Pool. Resident will be held responsible for any violations of these Rules by Resident’s guests. 4. All individuals using Pool must have a minimum level of swimming proficiency and/or must be properly supervised and utilize the appropriate lifesaving or floatation equipment to safely and properly utilize Pool. Any Resident who brings a guest or minor into Pool must insure that said individual is properly supervised and has the appropriate level of swimming proficiency to safely and properly utilize Pool. 5. Persons under the age of fourteen (14) should not use Pool without an adult in attendance. 6. No glass, alcohol, or tobacco is permitted anywhere in Pool or Pool area. Possession of alcohol will result in immediate removal from Pool and may result in revocation of Pool use privileges. 7. Food is not allowed in Pool or Pool area, except in designated eating areas and/or with Owner/Agent’s consent. Nonalcoholic drinks in non-glass containers are permitted as long as the containers are properly disposed of in the trash after use.
8. Inappropriate behavior such as running, pushing, horse-play, wrestling, excessive splashing, standing or sitting on shoulders, spitting of water, or any other dangerous or disturbing conduct is not allowed in Pool or Pool area and may result in removal from and/or restriction of use of Pool. 9. No loud noises or substantially annoying behavior shall be allowed at any time in or around Pool. Voices should be kept at a minimum, cell phone usage and radios should not disturb others. Audio equipment must be used with personal headphones in Pool area. 10. Diving is not allowed at any time in Pool. 11. All individuals using Pool or in Pool area must be toilet trained and/or utilize the appropriate non-leakage pants or swim diapers and insure feces or urine is not leaked into Pool. 12. Persons having or who have had active diarrhea within the previous 14 days shall not enter the pool or spa water. 13. All individuals using Pool must shower before entering Pool. All individuals using Pool must dry off carefully before exiting Pool area. 14. Proper swim wear is required to use Pool. Jeans, cutoffs, or thongs are not allowed. 15. Pool safety equipment is not to be used except in case of an emergency. 16. No pets, excluding service animals or other animals allowed by law, are allowed in Pool or Pool area.

Individuals who are or appear intoxicated, under the influence of drugs or alcohol or are disorderly may be required to leave Pool and Pool area. Admission to Pool may also be refused to any individual having or appearing to have a communicable disease or infection, skin abrasions, open sores, colds, coughs, inflamed eye infections, nasal or ear discharge, wearing bandages or other evidence of contagion risk. 19. Resident acknowledges that NO LIFEGUARD WILL BE ON DUTY and that all persons using Pool or Pool area do so at their own risk and Owner/Agent shall not be held responsible for any accident, injury or damage resulting from or in connection with such use of Pool and/or Pool area. 20. Resident understands that he/she uses Pool at his/her own risk and agrees to release, indemnify and hold harmless Owner/Agent from any and all claims, damages, injuries or liabilities whatsoever resulting from the use of Pool and adjacent areas/facilities by Resident, Resident’s family and/or Resident’s guest(s), except injuries caused by the negligent or willful act of Owner/Agent. 21. This is our second property.
My husband and I met online.
