We are located in Fox Creek. It is 5 miles from Driggs, 3 miles to Victor, 31 miles to Grand Targhee Ski Resort, 28 miles to Jackson Hole, Wyo, 30 miles to Grand Teton National Park and about a 90 minute drive to Yellowstone. The Views are breathtaking.

SHORT TERM VACATION RENTAL AGREEMENT
Occupant, agrees to rent for vacation purposes the real property, a furnished residence at 4950 Skyline Loop Road in Victor, Idaho 83455, hereinafter referred to as the “Property.” The parties to this agreement are “Owner,” David Barton; and, Occupant.
Transient Occupancy: Occupant is renting the Premises as a transient lodger for the number of days agreed upon with the Owner who retains full possessor and access rights.
In order to reserve the above-described rental your payment must be paid in full to AIRBNB, unless otherwise discussed.
1.) SECUTIRY DEPOSIT: a refundable $500.00 security deposit will be included in your quote. You must notify Owner, David Barton, of any damage to the unit during your occupancy. Any damages that exceed $500.00 will be charged to the credit card of file. The house will be carefully inspected after each rental.
2.) ORDINANCES AND REGULATIONS: The owner of this Property permit a maximum of 15 persons, including children, for overnight stay and a maximum of 4 vehicles for overnight parking at this property. No parties, events, or excessive noise is allowed. Occupant and guests shall not disturb, annoy, endanger or interfere with neighbors or use the Property in any unlawful manner.
3.) ACCOMODATION: The property consists of five bedrooms and three bathrooms. Linens are provided, kitchen is equipped for customary and usual usage and there is a two car garage, and parking for two vehicles in the driveway. Absolutely no smoking or pets in this property.
4.) CANCELLATION AND TERMINATION: Cancellation by Occupant within 30 days of the commencement term will result in forfeiture of the rental amount minus fees and taxes. Cancellation greater than 30 days will result in forfeiture of ½ the rental amount minus fees and taxes. Owner may terminate this agreement if Occupant fails to make all payments when due and deny Occupant occupancy and Occupant shall forfeit one-half of the rental amount. Owner shall refund all amounts paid by Occupant in the event of damages to the premises, holdover by another occupant or any other force beyond the control of Owner that make the property unavailable to Occupant and Owner shall have no further liability to Occupant or anyone claiming under Occupant.
5.) CONDITION OF PREMISES: Occupant agrees to keep the premises, furniture, furnishings, appliances and fixtures clean and in place and agrees to notify Owner immediately of any damage. Trash is to be placed in the outside city trash can provided on the premises for recovery.
6.) ALTERATIONS: Occupant shall not paint, add or change locks or make any other alterations to the Property.
INJURY AND DAMAGES: Occupant agrees to indemnify and hold Owner free from all liability, loss or damage arising from any injury suffered on the premises by Occupant, guests, invites or licensees of Occupant. Owner, will not be responsible for any loss or damage to Occupants property, including vehicles, due to fire, theft, vandalism, rain, water, or any other cause. Owner does no insure against personal injury to Occupant, guest or licensees due to any reason other than the condition of the Premises. Owner recommends that the Occupant carry or obtain insurance to protect Occupant, guests and licensees and their personal property from any loss or damage.
7.) LIMITATIONS OF OWNER’S LIABILITY: Occupant waives all claims against the owner for injury to person or damages to goods or property on or about the premises form any cause whatsoever, except gross negligence of the Owner. The Occupant will indemnify the Owner against any loss or damage to the property or persons arising from the failure of the Occupant to maintain the premises in good condition or arising from the use of the premises by the Occupant. The Owner shall not be liable to the Occupant for any damage or loss caused by any act of negligence of neighbors or contiguous properties. The Occupant agrees to pay for any and all damages or loss to the premises including building or grounds, and including and loss or injury suffered by such other occupants caused by misuse of the premises or negligence of the Occupant, and his family, friends, licensees or invitees.
8.) CONSTRUCTION: No party to this Agreement shall be deemed the drifter of this Agreement for purposes of construing the provisions of the Agreement, and all language in all parts of this Agreement shall be construed in accordance with its fair meaning, and not strictly for or against any party.
9.) ASSIGMENT AND SUBLETTING: Occupant shall not assign, let or sublet all or any part of the Premises and any assignment, let or sublet shall be void.
10.) DAMAGES: Occupant agrees that damages for violating the occupancy limits will result in forfeiture of the security deposit plus $150.00 per additional person (exceeding the occupancy limit) per each day unless other arrangements are made between owner and occupant. Failure to vacate the premises in a timely manner will cause Owner increased costs, potential liability to the next Occupant and other burdens for which Occupant agrees to pay Owner $200.00 per hour that Occupant is late vacating. Occupant will relinguish all copies of keys or opening devices to the premises, including any common areas; vacate the premises and surrender it to Owner empty of all persons; vacate any/all parking and/or storage space; and deliver the premises in the same condition less ordinary wear and tear as received upon arrival.
11.) ENTRY BY OWNER: Owner or its agents may enter the property to make repairs, provide services or to inspect the Premises within an hour’s notice. In the event of an emergency Owner or its agents may enter the Premises at any time without notice.
12.) DENIAL OF OCCUPANCY: Owner may deny Occupant or its guest(s) access and occupancy to Premises in the event of a violation of the provisions of this agreement.
The parties agree to accept facsimile transmissions as originals and electronic signing and acknowledgement.
