Renting a place to stay for a couple nights or a week can be more than just a hotel room with queen size beds. It can be a place that has a warm atmosphere, fully equipped kitchen, and all the amenities of home.
Check-in and Check-out
1.Check-In: Check-in time is 4:00 pm on the day Tenant’s scheduled reservation begins. No early check-ins, absent prior consent of Owners. Prior to arrival, Tenants will be given their code, as well as any special instructions or updates that may be applicable to the Cabin.
2.Check-Out: Check-out time is 11:00 am (SHARP) on the day Tenant’s scheduled reservation ends. Any delay in check-out, absent prior consent of Owners, shall result in Tenants being charged for another night’s stay.
3.The Cabin is supplied by a cistern in the basement. Water is trucked in and sewage is trucked out. There will be adequate water for the Tenant’s stay, but the Tenant must conserve water. By entering this agreement, the Tenant understands that water on the cabin property is a limited resource not connected to any constant water supply, and that if the water is used, it may take days to replenish the water supply. The Owner hereby covenants and agrees to make their best and continuing efforts to ensure that the water supply is stocked.
4.Smoking: This is a NON-SMOKING Cabin. Anyone smoking in the cabin will result in a loss of the security deposit. If you are a smoker, smoking can be done on the gravel driveway, and all debris from smoking must be contained in a non-flammable container. Any debris discarded by the tenants onto the property will result in a loss of security deposit. Any damages occurred to the property, or surrounding properties due to the tenants’ negligence in properly discarding cigarettes, matches etc., will be the sole responsibility of the tenant(s).
5.There is an additional $50.00 fee to cover wear and tear for tenants that keep pets in the cabin.
6.Cleaning: Tenants shall be responsible for any undue and/or unreasonable cleaning of the Cabin immediately subsequent to the Tenants’ departure. A cleaning charge of CAD$ 30.00 per hour, with a one (1) hour service minimum will be assessed.
Tenant Alterations or Improvements
7.The Tenant shall make no changes, alterations or improvements to the Premises without the prior written consent of the Owner.
Fire & Fire Safety
8.The Tenant shall at all times exercise and take reasonable precaution to protect the Premises against fire and shall not keep or store, or suffer or permit to be kept or stored in or on the Premises any inflammable oils, substances, or materials, or carry on any activity whatsoever to be contrary to any municipal by-law.
9.There is an outdoor fire pit on the property for tenant(s) to use. This shall be the only location for an outdoor fire on the property. This must be used responsibly and fires must be small and remain in control.
10.The Tenant(s) is responsible to check with local authorities to see if there are any fire bans in the area of Nordegg. Tenant(s) are responsible for any fines occurred for not following local fire restrictions. Tenants must also use the fire wood provided responsibly and not over consume the fire wood. Any over consumption of firewood will result in an additional premium firewood fee. Tenants are responsible for recording their firewood use in the event of a dispute between Owner and Tenant concerning the amount of firewood used.
11.At NO time shall any trees, bushes, or other natural items on the property, or surrounding properties, by cut down or scavenged to be burned. If this occurs it will result in a loss of security deposit.
12.There is a fireplace on the interior of the Cabin. Tenant(s) are allowed to use the fireplace. There are instructions on how to light the fire. This must be used responsibly and fires must be small and remain in control. The Tenant(s) is responsible to check with local authorities to see if there are any fire bans in the area of Nordegg. Tenant(s) are responsible for any fines occurred for not following local fire restrictions. Tenants must also use the fire wood provided responsibly and not over consume the fire wood. Any over consumption will result in the loss of security deposit. At NO time shall any trees, bushes, or other natural items on the property, or surrounding properties, be cut down or scavenged to be burned. If this occurs, it will result in a loss of security deposit. At no time shall any cooking take place inside the fireplace. The only items to be burned are wood and newspaper.
13.There is a barbeque provided for the Tenants to use. This must be used responsibly. The grill is to be pulled away from the Cabin slightly, to not cause damage to the Cabin. Cleaning the grill is the responsibility of the Tenant(s). If the grill is not cleaned after use this will result in extra cleaning charges being taken from the damage deposit.
14.Areas that are locked, such as Owner’s personal storage spaces, for which Tenants are not provided a key, are off limits to the Tenants. Any attempt to enter locked areas is cause for immediate termination of this agreement, forfeiture of all monies paid, and Tenants will be liable for any damage and/or missing items. For greater clarity, all locked areas for which the Tenants are not provided a key are private property and no tenancy or easement is given.
Number of Occupants
15.Bedrooms are configured with a queen size bed in the master bedroom and a queen size bed in the second bedroom. There is a pull out queen bed in the loft area. The sleeping capacity for this cabin is:
bedroom 1 = 2,
bedroom 2 = 2, and
loft area = 2
TOTAL: 6 occupants
The maximum number of guests for a Tenant’s stay is limited to six (6) persons.
Auxiliary Power Option
16.The Tenant may hook up a Recreational Vehicle (RV) or other machinery to the cabin’s electrical power if the tenant agrees to an additional auxiliary power fee of $25.00 per day for a term equal to the total rental period.
“I agree to the additional $25.00 per day fee as described above for the license and use of the Cabin’s electrical power to another auxiliary source (such as an RV).”
17.The Owners covenant and agree to ensure the property is properly maintained, clean, equipped, and functional, bearing in mind the differences in standards from one country to another. Rental rates include utilities, linens, and towels. There is a comprehensive information binder in the Cabin that describes in detail the use of all of appliances and barbeque. It also provides an extensive list of personal recommendations on things to do and see as well as restaurant menus. The cabin is fully furnished and equipped with the amenities of modern living, including a fully equipped kitchen, TV, Blue-ray/DVD/VCR player (with several movies for Tenants to enjoy). All items supplied by Owner are the property of the Owner to which the Tenant is licensed to use. All amenities are to remain at Cabin for other Tenants to use. Failure to comply will result in a charge to replace the amenity or forfeiture of the security deposit, whichever is more.
No Daily Maid Service:
18.While linens and bath towels are included in the Cabin rental, daily maid service is not included in the rental rate. Towels and Linens provided by the Owners may not be removed from the cabin.
Issues and Access:
19.Any problems which occur during the rental period should be reported as soon as possible; and, under any circumstances, no later than 72 hours to the Owners. All such complaints must also be followed up with written details by the Tenant to the Owners. Guests shall allow a representative for the Owners access to the rental property for purposes of repair/inspection. Owner shall exercise this right of access in a reasonable manner and give the Tenant a minimum of 24 hours notice.
20.Time is of the essence.
21.The Tenant and the Landlord shall comply with the requirements under all laws and ordinances of or in force in Canada and in Alberta, and under all municipal by-laws.
22.There are no representations, warranties or conditions, expressed or implied, statutory or otherwise, other than those contained herein.
23.No covenant or condition of this Agreement may be waived by a benefiting party except by written consent and forbearance or indulgence in any regard shall not constitute a waiver of the covenants to be performed by the other party to which the same may apply.
24.All notices, demands or requests shall be in writing and shall be delivered to the following addresses:
25.The covenants herein contained on the part of the Owner or the Tenant to be paid, performed or observed shall be and shall at all times be construed to be the joint and several covenants of all of the persons being the Owner or the Tenant, as the case may be.
26.Executed copies of this lease Agreement transmitted electronically (by fax or email) shall be binding on the parties.
27.This Agreement may be amended in writing only with the signature of both the Tenant and Owner.
The Owner shall make their best efforts to maintain the Cabin in the best of condition. The Owner expresses no guarantees, express or implied, regarding suitability or fitness for any particular purpose. The Owner does guarantee that appropriate repair and/or replacement will be performed as soon as possible under prevailing circumstances. It is the Tenant’s responsibility to immediately notify Owner of any issues that they incur during their stay so that the repair and/or replacement may be promptly taken care of. Owner is not responsible for any inconveniences for which Owner has no immediate control. These inconveniences may include, but are not limited to, the following: (i) breakdown of TV/Blue-ray/ DVD/ VCR players, hot tubs, saunas, and/or other recreational appliances or devices; (ii) power outages; (iii) adverse weather and/or road conditions; (iv) construction in the area; and (v) Cabin that is not decorated and/or accommodated to the Tenant’s individual tastes. Owner shall not be held liable, or otherwise take any responsibility, for any injuries that may occur to Tenant(s), and/or the Tenant’s invitee(s), that is caused or permitted to be caused by the intentional, unintentional, negligent, or careless acts of said Tenants, and/or invitees. By the written or electronic endorsement of this Agreement, the Tenant agrees to forever hold-harmless and indemnify the Owner from any liability and/or responsibility arising there from.
