Rental Agreement and Contract
This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date agreed by and between the undersigned person(s) or renter(s), (the “Guest”) and the undersigned owner, manager or agent (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
CANCELLATION POLICY. The time factor is critical in vacation rentals, and your reservation will hold this rental off the market for a period of time. If you cancel for any reason after we have mailed your Confirmation, your rent cannot be refunded unless the vacation rental is re-rented (and then less a $150.00 Administrative Fee). The earlier you warn us that you may need to cancel, the better the chances of re-renting.
PROPERTY CONDITION / SECURITY DEPOSITS. When you arrive, please check the vacation rental for cleanliness and damage. Notify us promptly of any problems or existing damage. You agree to leave the vacation rental in arrival condition with no physical damage, rental and yard neat and tidy, dishes washed, removed from dishwasher and put away , spills wiped up, trash removed, etc.
Late check-out, trash and recycling left in vacation rental or grounds needing more-than-reasonable cleaning are grounds for security deposit claims. If there is any damage or destruction to any property or contents, you accept all responsibility for any repair or replacement of all damaged property.
USE OF PROPERTY: Guest acknowledges that use of amenities such as stoves, ovens, grills, utensils, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guest’s own risk.
CLEANING FEE AND EXCESSIVE CLEANING : Your cleaning fee covers normal wear and a final cleaning. Any excessive cleaning required will be billed to you at the rate determined by our third party cleaning service.
OWNERS SET SPECIFIC RULES regarding the maximum number of occupants, pets, smoking, etc. As the vacation rental owner’s representative, we enforce these rules, and may evict renters and their guests when they are not complied with. Pets are allowed at the vacation rental, which includes pets belonging to your guests, with prior written agreement and a pet fee. Large gatherings, house parties, etc., are absolutely not permitted. Sub-letting is not permitted. Any disturbance resulting in neighborhood complaints or police action, other illegal activities, damage to the vacation rental or property, or violation of this agreement or of rules and regulations governing the vacation rental, will be considered sufficient cause for immediate termination of your stay, and all monies paid will be forfeited. This agreement does not create a tenancy for the vacation rental; you can be removed from the vacation rental without process of law if you violate these rules or do not depart at the appropriate time.
THE OWNERS ARE NOT RESPONSIBLE for loss, theft or damage to your belongings while at the rented vacation rental. Management and the property owner will be held harmless.
YOU AGREE TO NOTIFY US IMMEDIATELY if a maintenance problem develops at your vacation rental so we can have it remedied as quickly as possible. Owners and Agent reserve the right to make repairs as necessary, and to enter the vacation rental with reasonable notice, or without notice if you cannot be reached.
KEY Code Procedures: Arrangements will be made for your entrance upon arrival by key code. The day of check-out, please inform us of your departure by text @(PHONE NUMBER HIDDEN).
YOU ARE RESPONSIBLE FOR YOUR CHOICE. This vacation rental is individually owned and managed. We have described our vacation rental in detail to the best of our ability, but we cannot make the decision for you and will not be responsible if you are not happy with your choice on arrival. The rent will not be refunded and cannot be transferred to another location.
ALL SCHEDULED PAYMENTS MUST BE RECEIVED BY THE DUE DATE OR WILL BE SUBJECT TO A 10% LATE FEE OR LOSS OF RESERVED DATES AT MANAGEMENT/OWNER'S SOLE DISCRETION.
This addendum hereby overrides and surpasses any and all other clauses in this lease. By signing below, you hereby agree and accept this addendum:
Management and law enforcement have unlimited and unrestricted access to this unit at any time what-so-ever without interference for any cause what-so-ever. Any cause that results in a neighbor complaint and/or a law enforcement presence at this unit, at the sole discretion of law enforcement and management, will result in the following:
1.This lease agreement will automatically and immediately be voided in its entirety.
2.You agree to immediately gather your personal belongings and leave promptly. No further access will be granted for any purpose.
3.After one hour of time following the presence of law enforcement, or if you fail to adhere to #2 above, you understand that you are trespassing.
4.All trespassers will be prosecuted to the fullest extent of the law.
5.You agree to pay all costs associated with any fines, fees or summons associated with or caused by your actions, including but not limited to legal counsel needed to defend managements position.
6.100% of all deposits will be immediately forfeited as management fees and will not be eligible for use towards any costs stated in #5 above, any excess cleanings fees, or any costs for repair or replacement.
I have read and understand the severity of this addendum and acknowledge this addendum and lease agreement takes precedence over any and all conflicting terms of this agreement.
